Article 2 – Scope of Application
These General Terms and Conditions of Sale (GTC) apply to all orders placed on the website clairobscurboutique.com.
Access to the site and the purchase of our products are strictly reserved for adults (18 years and over). By placing an order, the customer declares to be an adult.
Any order implies full and complete acceptance of these GTC.
Article 3 – Products
Our products are handmade accessories crafted in France. As each piece is unique, slight natural variations may appear and are part of the artisanal character of our creations.
The photographs and descriptions on the site are as accurate as possible but cannot guarantee a perfect match with the product received, especially concerning color nuances.
Article 4 – Prices
Prices are indicated in euros (€) all taxes included (TTC). Clair Obscur Boutique reserves the right to modify its prices at any time, it being understood that the applicable price is that in force at the time of order validation.
Delivery costs are indicated separately before order validation.
Article 5 – Order
The order is validated after:
- Product selection and addition to cart
- Cart validation and entry of delivery information
- Choice of delivery method and payment method
- Order confirmation and payment
A confirmation email is sent upon receipt of payment. Clair Obscur Boutique reserves the right to cancel any order in case of suspected fraud or obvious error.
Article 6 – Payment
Online payments are accepted by bank card (CB, Visa, Mastercard) and via Shop Pay, through a secure connection.
Payment is debited at the time of order validation.
In the physical store, we accept cash and bank card.
The statement appearing on your bank statement will be: SP CO Boutique.
Article 7 – Delivery
Orders are dispatched within 1 business day after receipt of payment, in a discreet package that does not mention the nature of the products.
Delivery rates vary depending on the weight of the order and the destination. They are calculated and displayed at checkout.

The indicated times are given as an estimate and run from the shipping date. Clair Obscur Boutique cannot be held responsible for delays attributable to the carrier.
In-store pickup is possible in Cap d'Agde (2 Avenue Amphitrite, Av. de Port Ambonne, 34300 Agde), during opening hours.
In case of delay, the customer may contact the seller to find a solution. In accordance with current legislation, the seller remains responsible for the proper delivery of the product until its receipt by the customer.
Article 8 – Order Cancellation and Right of Withdrawal
Cancellation before shipment: An order cancellation can be requested before the item is shipped. To do so, the customer must contact Clair Obscur Boutique as soon as possible after validating their order.
In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to provide any reason.
To exercise this right, the customer must contact us at: boutique.clairobscur@gmail.com, indicating their order number and the item concerned.
After exercising their right of withdrawal, the customer has a period of 14 days to return the product. The refund includes the initial standard delivery costs (excluding additional costs related to an express delivery method).
The product must be returned in its original condition, allowing for its re-sale. The customer's responsibility may be engaged in case of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the product.
Return shipping costs are the responsibility of the customer, unless the product has a defect attributable to Clair Obscur Boutique.
The refund will be made within 14 days after receipt and verification of the return, by the same payment method used for the order.
Article 9 – Legal Guarantees
All our products benefit from the legal guarantee of conformity (Articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

Article 10 – Personal Data
The data collected during the order is used solely for processing the order. It is not transferred to third parties, except as necessary for delivery (carrier).

Article 11 – Liability
Clair Obscur Boutique cannot be held responsible for indirect damages resulting from the use of the products. The products are intended for use by consenting and informed adults.
Article 12 – Mediation and Dispute Resolution
In case of dispute, the customer is invited to contact Clair Obscur Boutique to find an amicable solution.
Article 13 – Applicable Law
These GTC are subject to French law. Any dispute falls under the exclusive jurisdiction of French courts.
